Havasu officials says SB1070 ruling ‘guts’ immigration law

Phone calls and letters to Lake Havasu City representatives regarding Arizona’s new immigration law have been almost non-existent, but the consensus among several city officials seemed to lean toward disappointment to a partial block of the law Wednesday.

U.S. District Judge Susan Bolton blocked several controversial provisions of the law in Phoenix. Bolton ruled that several sections would “not take effect, including sections that required officers to check a person’s immigration status while enforcing other laws” and “delayed parts of the law that required immigrants to carry their papers at all times,” according to a report from the Associated Press. But many city officials said Bolton didn’t just block several pieces of a new immigration law — she “gutted it.”

“I would say it was gutted,” Mayor Mark Nexsen said Wednesday afternoon after reading about Bolton’s decisions. “From the bits and pieces I’ve seen, it appears that essentially it has made the law ineffective, which is very unfortunate.”

Nexsen said he was originally in favor of Gov. Jan Brewer’s move to sign SB1070 into law earlier this year.

“I think that the law mirrored the federal law and I think that in light of the state requesting help for many years and getting no answers, we had to do something on a statewide basis to control the border,” he said. “My guess is (Brewer’s attorney) is going to appeal the ruling but I think unfortunately it’s going to have to go through the legal process … and that takes forever.”

State Sen. Ron Gould, R-Lake Havasu City, said he was also disappointed with the moves made Wednesday.

“She essentially gutted the law … and I’m sad the federal government saw fit to sue Arizona for implementing a federal law,” Gould said. “The upside to this is that President (Barack) Obama’s actions will guarantee that Republicans will take control of Congress. … We’ll take control of the House and Senate because of these actions.”

Gould said he expected some form of the law to be blocked in court.

“The chances would be pretty slim that the law would get through unscathed,” he said. “But the court may recognize it’s an issue and we’ll run a bill again next session that addresses that issue worded the way they’d like it worded and have something stronger go through.”

But the state was “forced” to act when Brewer signed the bill into law, Gould said, because the issue went beyond party politics.

“We had a Republican administration for eight years that wouldn’t do anything and now we have a Democratic administration that won’t do anything so the state stepped up,” he said. “I think this is going to have more of an effect on our federal government than they realize.”

While dozens of organizations throughout the country have threatened to boycott Arizona in the last several months because of the law, tourism officials in the city think Lake Havasu City won’t see a downturn as a result.

“We have a feeling that there is going to be some push back, but I think if people read the law I think they’ll eventually realize it’s a non-issue,” said Lake Havasu Hospitality Association Executive Director Greg Tryon, adding that he was in favor of the law in its whole form. “I think the push would go away eventually but we’d notice a little bit of a difference. … I don’t think it would be long-term at all.”

Convention and Visitors Bureau President/CEO Doug Traub agreed.

“I think the impact to Lake Havasu City will be minimal,” he said. “Much of the groups that come here are non-traditional convention groups like youth sporting events or Winter Blast or (personal watercraft) events. They’re more interested in our outdoor amenities than the politics of what’s being passed in Phoenix. I think it’s going to have a different effect in Phoenix where these decisions are made, but not here.”

Traub said the ruling Wednesday should not have an impact on the city.

“In the three months I’ve been here, we’ve received no more than five letters and the rationale as to why they would not visit was not convincing. Whereas I know we’ve had the opposite,” he said, referring to a group that recently visited Havasu known as the “Buycott.”

“I think if anything, if you added up the bodies that have supposedly not come here because of the law and ones who have because of the law, I think we’re on the upside overall,” he said. “Some places in Arizona might be concerned but I don’t think it’s going to have any effect here.”

Mayor Nexsen said he’s also heard “nothing to indicate a change” in tourism in the city.

“I have talked to a number of Californians and it’s interesting that the ones I’ve talked to have supported (the law),” he said. “There are no absolutes … and I know the mayor of Los Angeles wanted to boycott us, but I don’t have any control over that. I’d say overall, it doesn’t seem to be having any impact on Lake Havasu City.”

" I am so sick of hearing people not only on this blog, but in the media as well condeming those of us who SUPPORT the new immigration bill. This is not a case about racism, racial profiling, or violating the rights of a human being what this is, is the PROTECTION of our countries future, our citizens lives, and the American way. This land was built by immigrants from all over. They came here for a better life for themselves and their families, just like the Mexicans. BUT they did it through the front door, not by climbing through a fence! They took pride in standing in line to become an American citizen, they learned our language, which by the way is ENGLISH, and they built business, served in our armed forces, lived and died for their dream of a better life. They didn't demand that we just give it to them because they came from a bad place. People in this country come from bad places or bad lives, but it is their choice what to do about it. Do you pick yourself up out of the despair and poverty you are in and educate yourself and work hard at your job or do you turn to a life of crime? That is every human's decision, it's called free will. No human being is entitled to a good life free from hard work, sacrifice, and ethics. If they want a good life they must work for it, this includes Mexicans. For people to say how horrible Arizona is in trying to protect ourselves and enforce a FEDERAL law should take a look at Canada. You cannot enter their country without proper identification and if you are a felon you can't get in at all. They have far less issues with illegals then we do because of such measures. What's wrong with America doing the same? I once was opposed to the idea of building this wall or fence around our borders just to keep the illegals out. I thought it would bring shame to all those immigrants who started this country. I thought it would go directly against what they were trying to do. Then I thought about our safety and how we take measures to protect ourselves and our families. People put bars on their windows and doors, they put in alarm systems, and motion sensored lighting. All of these additions to homes are not to keep the residents of that home in but to keep outsiders out. It is to protect our families, property, and lives. So, if we protect our houses so voraciously then why is it wrong to protect our state and our country? Maybe it is time for the Great Wall of America. All I know for sure is this...if a policeman or Secret Service agent stops a suspicious car driven by a Hispanic that is hovering outside the White House you cannot tell me that when that Hispainic individual tells them that he doesn't have to carry his documentation around that they are just going to say, "Oh you're right...go on your way.". NO, they are going to take that person out of the car and detain them as long as necessary to determine their identity and status as an American citizen. Why? Because it is their first and foremost job to protect the President of the United States of America. The sad part of it, is that same man they are protecting won't protect his citizens in the same way. I am sorry, but I don't think that anyone should be able to comment on life in the border states until you come live life in the border states. How dare anyone say that people who enter this country illegally should be treated better than those who are supposed to be here. How many more people have to die, how much more drugs have to pollute our streets, and how much more gang violence to we have to endure before the government of this country decides that it is enough? When will my life as an American tax-paying law abiding citizen mean the same thing as an illegal who crossed into this country in the dead of night through a barbed wire fence? "

It s the ones that ae here illegally that don't pay taxes don't file because they don't have a ss number and don't want to have to pay taxes. Arliss what makes you think illegals pay taxes? Unless they are filing with stolen ss numbers either way it's wrong. I see no reason why an officer can't conduct a traffic stop ask for id from anyone they stop, you have to carry id with you it's the law. If they say no speak english no papers no id then border patrol should be contacted for an interview over the phone let border patrol decide if they want to pick them up or have them cut loose. Border Parol needs more officers to be in each city in AZ and available to any police department who needs them to respond. How can our officers just cut them loose be cause they say no english no papers no id? We can't drive a vehicle without id we have to have a valid dl to drive a vehicle even if we drive into Mexico we have to have a passport to get across the border. Our law enforcement officers have a job to do which is to make sure drivers are licensed to drive. Sure Mexico is a mess and they don't want to live in their own country anymore but if it takes 6 years to become an American Citizen then so be it. Unless America can find a way to shorten the length of time it takes. To lleh with those who are screaming their rights are being violated because they get asked for id, do we yell that in Mexico? Damn straight we don't. GET OVER IT! "

" I know I am going to get slammed on this, but here goes. Most feel that it is not fair to all legal immigrants, etc. that followed the established rules understanding that they are a little archaic and the waiting period is quite long, to see illegal aliens not abiding by the same guidelines. Most legal immigrants are also seeking a better life than what is available in their current country(ies). There are huge amount of illegal immigrants that have jobs, pay taxes, and are not a burden on the system. Maybe something should be done to accommodate them. I am not sure exactly how that should work but they should not be allowed a chance at citizenship before any that are playing by the established rules of immigration. Those remaining that do not have a job, but are just taken some form of government assistance should be returned to there country of origin. Any that have broken any laws should be returned to their countries of origin. Dealing with any one born here to illegal alien parents (those under the age of 18) should be given the option of staying in America or going with their parents. If over 18, they must remain being that they are considered an American adult citizen. If they would like to sponsor their parents, the children must show that they can support them without assistance from the government for five years.

Doing the boom time, many did not feel the illegal immigrant was a burden. But, lets be realistic. How many people like to pay for some one to do nothing? Me personally, I have worked very hard to get where I am now. There were no handouts for me but I do believe in helping those who are struggling up to a certain degree. If some one is in a bad situation not of their making, yes, I am more likely to assist in whatever manner I can. But if this person just wants to sit on there butt and do nothing to better themselves, no, I will not help them - illegal or not. I lived my life with the understanding that if I worked hard, I can have a better life. If a person from another country wants to come here to have a better life, do it the proper way. That sentiment is not just limit to "Latinos" like some feel, but to all non-citizens from every corner of the planet. To figure out how this is to been done will be a very difficult task. But the first step toward that would be to secure the border. Maybe it could be done with a fence and such, but until that happens, actual troops should be place there to deter illegal crossings. This should occur at both the north and south borders. Other countries use their armed forces to protect their borders. I just can't grasp the concept that we can't do that. Secure the border and fix all the problems with the visas should stem the influx of illegal aliens, which would give the government time to deal with those here in a manner where, maybe everyone would be satisfied. I can't say I understand how any immigrant feels because my ancestry is not made of of immigrants. I feel if the illegal immigration problem can be solve in an equitable manner, the country will better able to deal with the current issues that stand a chance of changing America for the worst. As I stated earlier, I'm going to get slammed for this. If so, so be it. "
